Booking Terms

1. Introduction and Scope

These Booking Terms govern all reservation requests, confirmed bookings, charters, tours, add-ons, and related services offered by La Isla, whether arranged through our website, a third-party booking platform, email, phone, messaging applications, or offline payment arrangements.

These Booking Terms apply specifically to the reservation and experience itself, including pricing, payments, cancellations, rescheduling, operational decisions, safety requirements, participation conditions, and liability-related provisions. They are separate from and in addition to our general Terms of Service and Privacy Policy.

If there is any conflict between these Booking Terms and our general Terms of Service, these Booking Terms will control with respect to the reservation and the experience.

3. Reservation Requests and Confirmation

A reservation is considered confirmed only after the required initial payment has been successfully received and the booking has been accepted by La Isla.

Unless otherwise stated in writing, a deposit equal to fifty percent (50%) of the total booking amount is required to confirm the reservation.

The remaining fifty percent (50%) balance will be automatically charged to the same payment method on file approximately seventy-two (72) hours before the scheduled departure time, unless another payment arrangement has been expressly approved by La Isla in writing.

It is the guest’s responsibility to ensure that the payment method on file remains valid and authorized for the remaining balance. If the automatic charge cannot be completed, La Isla may contact the guest to request updated payment information. If the balance is not successfully collected within the required time, La Isla may suspend, cancel, or release the reservation without liability, subject to any applicable cancellation terms.

4. Pricing, Currency, Taxes, Fees, and Gratuities

All prices are stated in U.S. Dollars (USD) unless expressly stated otherwise.

Unless expressly stated otherwise, published prices do not include applicable taxes, gratuities, service recognition, third-party booking fees, payment-processing fees, optional add-ons, or any other extra charges that may apply to the selected experience.

A third-party booking fee may apply to reservations processed through our online booking platform. Any applicable taxes, booking fees, and other charges will be shown during the booking process or in the booking confirmation.

Gratuities are not included unless expressly stated otherwise. Any tip, gratuity, or service recognition remains voluntary unless a mandatory charge is specifically disclosed in the booking flow or in writing. All gratuities will preferably be accepted in cash.

Where the website displays a price as “USD++,” that pricing means the published amount is a starting price only, based on the minimum applicable passenger count for that experience. The total price may increase depending on factors such as the number of guests, selected add-ons, upgraded beverage packages, longer duration, additional services, or other booking-specific selections.

All pricing is subject to availability, operational conditions, and correction of obvious clerical or technical errors.

5. Payment Terms

For online reservations, payment is made by credit or debit card through the designated booking or payment platform.

For offline reservations approved by La Isla, payment may be accepted by bank transfer, cash, or another method expressly authorized by La Isla in writing.

Unless otherwise agreed in writing, fifty percent (50%) of the total booking amount is charged at the time of confirmation, and the remaining fifty percent (50%) is automatically charged approximately seventy-two (72) hours before departure to the payment method on file.

If a refund is issued, any third-party booking fees, platform fees, or payment-processing fees charged by FareHarbor or another booking/payment provider are non-refundable unless required otherwise by applicable law.

The guest is responsible for ensuring that all payment information provided is accurate, current, and authorized. La Isla reserves the right to refuse, cancel, or hold a reservation if payment is declined, reversed, disputed, or reasonably suspected to be unauthorized or fraudulent.

6. Guest Count and Capacity Limits

The number of guests included in a booking must match the reservation details confirmed with La Isla.

Pricing may vary depending on the number of guests participating in the experience. In general, a higher guest count may result in a higher total booking price for the reserved vessel or service.

La Isla reserves the right to refuse boarding, modify arrangements, or require pricing adjustments if the actual guest count differs from the confirmed booking, if safety considerations require changes, or if operational or regulatory limits apply.

7. Guest Cancellations

Cancellation requests must be submitted in writing by email, messaging channel, or another contact method authorized by La Isla. The effective cancellation time will be the time the request is received by La Isla.

Unless otherwise stated in writing for a specific vessel, season, promotion, or private arrangement, the following cancellation policy applies:

  • More than seventy-two (72) hours before the scheduled departure time: full refund of amounts paid, excluding any non-refundable third-party booking, platform, or payment-processing fees.
  • Between forty-eight (48) and seventy-two (72) hours before the scheduled departure time: fifty percent (50%) refund of the total booking amount, excluding any non-refundable third-party booking, platform, or payment-processing fees.
  • Less than forty-eight (48) hours before the scheduled departure time: non-refundable.

Refunds, if approved, will be returned to the original payment method unless La Isla agrees otherwise in writing. Processing times may vary depending on the payment provider or issuing bank.

8. Rescheduling

Rescheduling requests must be submitted at least 72 hours before the scheduled departure time.

All rescheduling requests are subject to vessel availability, operational capacity, weather and sea conditions, seasonal demand, and any price differences applicable to the new date, time, guest count, or selected services.

Approval of a rescheduling request is not guaranteed. If a requested new date or experience carries a higher price, the guest must pay the difference before the change is confirmed. If the new reservation has a lower price, any credit or refund will be handled at La Isla’s discretion unless otherwise required by applicable law or expressly stated in writing.

Unless otherwise approved by La Isla, repeated or last-minute rescheduling requests may be treated as a cancellation and may be subject to the cancellation policy then in effect.

9. Late Arrivals and No-Shows

Guests must be at the designated meeting point at least five (5) minutes before the scheduled departure time. Arrival earlier than that time is strongly recommended. Five (5) minutes before departure is the latest permitted arrival time.

  • Sidhi, Barta, Alora, and Manta – Gate G
  • Deva – Gate B
  • Pelican 11 – Gate K

This is the latest permitted arrival time; any arrival after that point will be considered late, and the reserved experience time may already be running. Late arrival may reduce the duration of the experience, and the experience will not necessarily be extended to recover lost time.

It is the guest’s responsibility to arrive on time and at the correct location. La Isla is not responsible for missed departures caused by traffic, navigation errors, transportation delays, inability to locate the meeting point, or other circumstances on the guest’s side.

No-shows, missed departures, or cancellations made after the scheduled departure time are non-refundable.

10. Weather, Sea Conditions, and Captain’s Authority

All charters and experiences are subject to weather, sea, port, and other operating conditions.

La Isla and the vessel captain reserve the right to modify, shorten, postpone, reroute, suspend, or cancel any experience, stop, activity, or onboard service whenever they determine, in their sole reasonable judgment, that conditions are unsafe, unsuitable, or likely to affect safe operation.

The captain’s decision regarding navigation, route, anchoring, swimming, snorkeling, paddleboarding, alcohol-related restrictions, onboard conduct, and any other safety-related matter is final and must be followed by all guests.

If unsafe or restricted conditions prevent the experience from operating as planned, La Isla may recommend a reschedule, partial adjustment, alternative arrangement, or refund, as applicable under the specific circumstances and any written policy then in effect.

11. Guest Health Disclosures and Participation Requirements

Guests are responsible for determining whether the booked experience is appropriate for their personal health, physical condition, swimming ability, mobility, age, and any other individual circumstance.

Guests must disclose in advance any relevant medical, physical, or participation-related condition that could affect safety, including, for example, pregnancy, limited mobility, recent injury, seizure conditions, severe allergies, cardiac or respiratory conditions, or any other circumstance that may require accommodation or special attention.

La Isla and the captain may restrict or deny participation in any water activity or other part of the experience if, in their reasonable judgment, participation would be unsafe for the guest, other guests, or the crew.

Failure to disclose relevant health or participation-related information may affect the guest’s ability to participate and will not automatically entitle the guest to a refund.

12. Health and Medical Emergencies

Guests acknowledge that La Isla vessels operate in a maritime environment where immediate medical facilities may not always be available.

Crew members are trained in basic safety and emergency procedures, but guests remain responsible for their personal health and medical conditions.

If you have a medical condition that may require attention during the experience, please notify our team in advance.

13. Onboard Conduct and Alcohol Policy

For the safety of all guests on board, participants agree to follow all safety instructions provided by the captain and crew. This includes guidance related to movement on board the vessel, use of safety equipment, swimming or water activities, and weather or navigation conditions.

Failure to follow crew instructions may result in restrictions on certain activities for safety reasons.

Alcoholic beverages may be served during certain experiences. For the safety and comfort of all guests, responsible consumption is required at all times.

The crew reserves the right to limit alcohol service to any guest who appears intoxicated or whose behavior may affect the safety of others.

Abusive, dangerous, or illegal conduct may lead to activity restrictions or termination without refund where legally permissible.

14. Water Activities

Swimming, snorkeling, and other water activities may be offered depending on the experience.

Participation in these activities is voluntary and may be restricted if weather conditions change, sea conditions become unsafe, or safety instructions are not followed.

Guests participate in water activities at their own discretion and risk.

15. Assumption of Risk

Our experiences take place in an open maritime environment.

While every measure is taken to ensure safety and comfort, conditions at sea may vary due to factors such as weather, ocean movement, and navigation conditions.

Guests understand that participating in activities on the water may involve inherent risks that cannot be entirely eliminated.

By boarding and participating in a La Isla experience, guests voluntarily accept these natural conditions.

16. Personal Belongings

Guests are solely responsible for their personal belongings at all times, including while boarding, onboard, in the water, at the marina, during transportation, and after disembarkation.

La Isla is not responsible for lost, stolen, wet, damaged, or misplaced personal items except to the extent liability cannot be excluded under applicable law.

Guests should avoid bringing valuables or items that may be damaged by water, sunlight, salt, movement of the vessel, or normal maritime conditions.

17. Limitation of Liability

To the fullest extent permitted by applicable law, La Isla shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of enjoyment, lost opportunity, lost profits, or similar claims arising out of or related to the booking or the experience.

La Isla shall not be liable for delays, route changes, shortened experiences, activity restrictions, cancellations, or other operational changes resulting from weather, sea conditions, port restrictions, regulatory actions, force majeure events, acts of third parties, guest misconduct, or compliance with safety requirements.

Guests participate in maritime and water-based experiences with knowledge that such activities may involve inherent risks, including vessel movement, changing sea conditions, boarding and disembarking, and optional water activities.

Nothing in these Booking Terms excludes or limits liability for any matter that cannot lawfully be excluded or limited under applicable law.

18. Photography and Media

During experiences, photographs or video recordings may occasionally be captured for documentation or promotional purposes.

If you prefer not to appear in such materials, please notify our crew before the experience begins.

19. Third-Party Booking Platform

Reservations may be requested, processed, or confirmed through a third-party booking platform, including FareHarbor.

Such third-party platforms may apply their own terms relating to platform access, account use, payment processing, technical functionality, and privacy practices. Guests are responsible for reviewing any applicable third-party platform terms presented during the booking process.

However, unless expressly stated otherwise, the charter, tour, or related experience itself is provided by La Isla and is governed by these Booking Terms.

Any applicable third-party booking fees, platform fees, or payment-processing fees charged through FareHarbor or another provider are separate from the experience price and, unless required otherwise by law, are non-refundable in the event of cancellation or refund.

20. Force Majeure / Events Outside Reasonable Control

La Isla is not responsible for cancellations or delays caused by circumstances beyond our control, including but not limited to severe weather conditions, government restrictions, port authority decisions, and natural events or emergencies.

In these cases, we will always work with guests to find the most reasonable solution whenever possible.

21. Privacy

Personal information collected in connection with a reservation, inquiry, payment, or participation in an experience will be handled in accordance with our Privacy Policy and any applicable booking-related privacy disclosures.

By submitting booking or guest information, the guest represents that the information provided is accurate and that the guest has authority to provide any personal information submitted on behalf of other participants included in the reservation.

22. Changes to Booking Terms

La Isla may update these Booking Terms from time to time by posting a revised version on its website or otherwise making the updated version available during the booking process.

Unless required by law or expressly stated otherwise, changes will apply prospectively and will not retroactively alter a reservation that has already been confirmed. Confirmed bookings will generally remain governed by the version of the Booking Terms accepted at the time of booking.

La Isla reserves the right to update operational procedures, meeting instructions, vessel assignments, and related non-material details as reasonably necessary to provide the experience.

23. Governing Law, Consumer Rights, and Dispute Handling

These Booking Terms and any dispute arising out of or relating to a reservation or experience shall be governed by the applicable laws of Mexico, without regard to conflict-of-law principles that would require application of another jurisdiction’s laws.

Nothing in these Booking Terms is intended to waive, restrict, or limit any non-waivable consumer protection rights that may apply under applicable law.

Guests with questions, complaints, or claims relating to a reservation or experience should first contact La Isla using the contact details provided in the booking confirmation or on the website so that we may attempt to resolve the matter in good faith.

Any dispute that cannot be resolved directly shall be submitted to the competent authorities or courts in accordance with applicable law and any mandatory consumer protection rules.

25. Acceptance

By requesting, confirming, paying for, or participating in a reservation or experience, the guest acknowledges that they have read, understood, and agreed to these Booking Terms.

Where the booking process includes a checkbox, button, digital acknowledgment, or similar acceptance mechanism, that action constitutes express acceptance of these Booking Terms, including the cancellation, rescheduling, safety, operational, and liability-related provisions.

The person completing the reservation represents and warrants that they have authority to accept these Booking Terms on behalf of all guests included in the booking.
